FARMERS MARKET RULES:
WBoT Mission:
The Wurtsboro Board of Trade's mission is to promote good will and cooperation among its members; to foster trade and commerce in the Village of Wurtsboro; to render constructive civic services for the promotion of the welfare of the community and of the citizens of the Village of Wurtsboro.
You have a right to expect the following from the Music & Farmers Market in the Park:
1. All vendors will be treated with professionalism, respect, and courtesy;
2. There will be equal application of all rules and regulations toward each vendor, without favoritism;
3. Fees will not be increased during the season under any circumstance;
4. In the event of personal emergencies, crop failures, and circumstances beyond the control of the vendor, all efforts will be made to assist the vendor in continuing at the market without penalty;
5. All disputes will be moderated fairly and equitably;
6. All efforts will be made to provide the Vendors with a clean, supportive and safe selling environment, complete with parking and bathroom facilities;
VENDOR RULES AND REGULATIONS
Admission to the Market is at the discretion of the Wurtsboro Board of Trade based (WBoT) on the following criteria:
1. The Market is limited to bona fide farmers/ growers/ producers in New York State & surrounding areas (NJ, PA, CT) or their agents. Producers must be in full control of production of all products. An agent is someone employed by the grower or their representative;
2. Producer's history of compliance with federal, state, local and market rules and regulations;
3. Farmer's may be asked to obtain a letter from the County Extension Agent certifying their status as a grower;
4. Farmers and all vendors are expected to cooperate in any inspection by the Market Manager, or WBoT members;
5. Non-Farm bakeries are permitted. They must be home bakeries or small family-owned commercial bakeries within 50 miles of Mamakating. Proof of production is required. Resale product and duplication of bakery products is prohibited. Bakery must be inspected by NYS Ag & Markets or DOH as applicable.
Time, Place, Set-Up and Take down, and Vehicles
The 2025 Music & Farmers Market in the Park will operate on Thursdays from June 12th through August 28th. The market will be open from 5 PM through 7 PM. On these nights we start Music in the Park at 6:30 PM, if a vendor would like to remain open after 7 PM they may do so. The WBoT assigns the Market layout positions and assignments based on optimal use and appearance.
1. The market will take place on 3rd Street in the Village of Wurtsboro, NY 12790 (Veterans’ Park).
2. All necessary paperwork must be received accepted by the WBoT before a vendor may occupy a space and/or open.
3. All vendors are to arrive no later than 4:30 pm for set up. Vehicles that have not been assigned specific space are to be moved from 3rd Street to the other street parking area. Vendors who arrive late without calling ahead may be denied admission to the market for that day.
4. Absences and late arrivals must call or email WBoT. wbotmarket@gmail.com
5. Booths are 10’x10’ in size. All display signage etc. are to be kept within the booth boundaries.
6. Pricing: 2025 Season will be $0.
7. Closure of the Market is at the discretion of the WBoT. In the event the market is closed due to inclement weather or an unforeseen incident, the WBoT will advise all vendors of the time the Market will be closing. If the WBoT suspends the Market for any reason and a vendor remains on the premises, the vendor does so at their own risk as they will be operating without permission.
8. No vendor is permitted to leave the market early for any reason without the permission of the WBoT. Leaving early may result in a fine of $25. Failure to pay the fine will result in your immediate termination.
9. The WBoT or designated representative for a specific market day, will be your contact for all matters and shall keep records regarding, payment, prepayment and all other matters.
10. Vendors are responsible to bring their own tents, tables, chairs, and trash receptacles. Vendors are responsible for cleanup in their respective booth areas and must take their trash off premises for disposal at the end of the day. What a vendor brings in, the vendor takes out. Electricity will not be available. Generator are not allowed.
11. All scales must be registered, sealed and battery operated.
12. Vendors may not bring vehicles on the road for any reason once the Market is open.
13. Vendors are permitted to park on Pine Street and Sullivan Street. Vendors and their employees or agents are expected to comply with all traffic laws.
14. No vehicle of any sort may block a road at any time. No produce or empty containers may be stored in or on any public highway, roadway, thorough fare or sidewalk.
15. All signage displays, and personal property must remain within the confines of the vendor booth.
16. Each vendor must display a sign which states the vendors name and all prices displayed clearly.
What May Be Sold/Quality of Goods
In addition to freshly picked vegetables, herbs, fruits, plants and flowers, the following may be sold, as long as home produced in accordance with regulations set forth by NYS Dept. of Agriculture: honey, eggs, baked goods, cheese, wine, ciders, jams, jellies, meats, oils, and soaps/creams.
1. The farmer may only sell produce grown (or goods made) on his/her own farm without permission of the WBoT. For the 2025 Music & Farmers Market in the Park, an individual may apply for a Special Exemption allowing he or she to purchase product from a farmer or farmers and re-sell at the Music & Farmers Market in the Park. The actual source of all products must be clearly indicated and all other rules and regulations related to the product remain in full force and effect.
2. All crop plans and/or product lists are preapproved by the WBoT at the time of application. New items not included in an original application may be applied for and may only be sold with approval of the WBoT.
3. The needs of the market change from season to season. Each vendor and their products offered will be re-evaluated each year. The market does not offer or guarantee any vendor, whether new or a previous vendor, a presence at the market or that the same products will be permitted each season. Permission to bring product one year or for a number of years does not guarantee or imply permission for this season.
4. All goods must be of fresh and good quality. The WBoT may direct inferior quality goods be removed from display at the market.
5. Any vendor selling product as organic must submit and display proper certification. “Organic” may not be used in any form unless a vendor is certified to do so.
6. Artisan crafts will be allowed at the discretion of the WBoT.
7. Unless otherwise expressed in writing, the market does not offer exclusive rights to any one Vendor to sell any one product. Market customers benefit from having a choice. The WBoT may deny entry of duplicate products if the number of Vendors offering the same or similar products is excessive or if that current market demand is being met. Such determination is solely at the discretion of the WBoT.
8. Agents of Farmers are permitted if so registered, but resale of any product purchased by the vendor is NOT permitted without express permission of the WBoT and only under the most limited of circumstances. Any vendor who sells product not of his/her own making while claiming that it is will be permanently expelled from the Market, without refunds or recompense.
9. ALL DECISIONS BY THE WBoT REGARDING WHAT MAY BE SOLD ARE FINAL.
Rules Enforcement/ Grievance and Vendor Conduct
1. The WBoT is responsible for enforcing all regulations and of resolving complaints between vendors.
2. In the event of conflicts or a refusal to comply with any specific directions or regulation, appeals must be directed in writing to the WBoT for review. The decision of the WBoT is binding.
3. Failure to comply with the decision of the WBoT will result in termination from the Farmers Market.
4. In the event a vendor has a grievance against another vendor, all efforts will be made to ensure confidentiality of both parties and to resolve the matter amicably and with dispatch.
5. In the event a customer has a grievance against a vendor, all efforts will be made to ensure confidentiality of all parties and to resolve the matter amicably and with dispatch.
6. Vendors are responsible for the behavior of their agents, employees, and volunteers.
7. Vendors, their agents, employees, and volunteers are expected to be courteous and honest in their business dealings at all times.
8. Disputes between vendors/harassment of individuals of any kind are not permitted and will not be tolerated. If a complaint is not settled at the Market between the vendors, or between the vendors and market manager, then the WBoT will make the final decision. Failure to comply with the decision of the WBoT shall subject the individual involved to sanctions including exclusion from future participation in the market.
9. Concerns/complaints regarding rules, codes, laws, and personnel relating to the Music & Farmers Market in the Park in any manner must be directed to the WBoT and pursued following the stated grievance process. Failure to do so may result in termination from the market.
